COUNCIL MINUTES May 13, 2013 <br />APPROVED <br />91 ii. Resolution No. 13 -54, Approving the Planned Unit Development — Final <br />i 92 Plan/Final Plat for the Village No. 5, Lino Lakes Assisted Living <br />93 <br />94 iv. 2nd Reading and Passage of Ordinance No. 03 -13, Vacating a Drainage <br />95 and Utility Easement for The Village No. 5 <br />96 <br />97 City Planner Larsen explained that the development contract related to the Lino Lakes Assisted <br />98 Living project was stricken from the agenda. The items before the council this evening relate to <br />99 allowing a variance to the setback, the final plan/final plat and an related drainage and utility <br />100 easement vacation. <br />101 <br />102 Ms. Larsen explained that the variance is requested because the proposal does not meet a maximum <br />103 five foot setback requirement. The applicant is trying to line up the addition with the existing <br />104 building so staff sees that as an appropriate request. Also an existing water main will require <br />105 relocation. Landscaping will be required that should help to minimize any depth lost due to the <br />106 variance. She added that the city's Planning and Zoning Board has recommended approval of the <br />107 resolution that includes findings of fact. <br />108 <br />109 Ms. Larsen then reviewed Resolution No. 13 -54 approving the final plat /final plan for the <br />110 development. This is a straight forward lot combination to create Village No. 5. The Planning and <br />111 Zoning Board has recommended approval of the resolution including conditions. <br />112 <br />113 Regarding Ordinance No. 03 -13, Ms. Larsen explained that the ordinance provides for vacation of a <br />1114 drainage and utility easement. This ordinance received 1st Reading at the last council meeting. <br />115 <br />116 Council Member O'Donnell moved to approve Resolution No. 13 -53 as presented. Council Member <br />117 Roeser seconded the motion. Motion carried on a unanimous voice vote. <br />118 <br />119 Council Member Roeser moved to approve Resolution No. 13 -54 as presented. Council Member <br />120 Stoesz seconded the motion. Motion carried on a unanimous voice vote. <br />121 <br />122 Council Member Rafferty moved to waive full reading of Ordinance No. 03 -13. Council Member <br />123 Roeser seconded the motion. Motion carried on a unanimous voice vote. <br />124 <br />125 Council Member O'Donnell moved to approve the 2nd Reading and passage of Ordinance No. 03 -13 <br />126 as presented. Council Member Roeser seconded the motion. Motion carried: Yeas, 5; Nays none. <br />127 <br />128 6B) Preserve at Lino Lakes <br />129 <br />130 i.
