WS – Item #1 WORK SESSION STAFF REPORT Work Session Item No. 1 Date: December 1 9 , 201 3 To: City Council From: Jeff Karlson Re: Amendment to CFD Joint Powers Agreement Background On November 19 the C entennial Fire District Steering Committee voted in favor of having each member city’s council consider an amendment to Section 2.6 of the Joint Powers Agreement, which would add the following language to the voting procedures: “However, passage of a motion shall require an affirmative vote from o ne member of each member city.” The Lino Lakes City Council approved the amendment on November 25. The Circle Pines City Council rejected it on December 10 by a 4 -1 vote. The following evening, the Centerville City Council also voted down the amendment by a 4 -1 vote. The Steering Committee reconvened on December 12 to discuss other options . After considerable discussion, the committee members agreed to continue its effort to find resolution and unanimously approved a 30 -day extension of the withdrawal period to allow the three cities more time to reach an agreement on voting procedures. The proposed amendment to Section 11.1 of the CFD Joint Powers Agreement was approved by the Circle Pines City Council on December 17 and by the Centerville City Counc il on December 18. The proposed language reads as follows: 11.1 Notice. Member municipalities may withdraw from the District only in accordance with this section. Notice to withdraw may only be given between January 1, 2014 and January 30, 2014, or du ring the month of December in odd - numbered years, beginning with December of 2015. Such notice shall provide a minimum of two (2) years notice to the remaining municipalities of the intent to withdraw. Requested Council Direction This item has been adde d to the special Council meeting following the work session for consideration of approval.
