<br />WS – Item #1 <br /> <br />WORK SESSION STAFF REPORT <br />Work Session Item No. 1 <br /> <br /> <br /> <br />Date: December 1 9 , 201 3 <br /> <br />To: City Council <br /> <br />From: Jeff Karlson <br /> <br />Re: Amendment to CFD Joint Powers Agreement <br /> <br /> <br />Background <br /> <br />On November 19 the C entennial Fire District Steering Committee voted in favor of <br />having each member city’s council consider an amendment to Section 2.6 of the Joint <br />Powers Agreement, which would add the following language to the voting procedures: <br />“However, passage of a motion shall require an affirmative vote from o ne member of <br />each member city.” <br /> <br />The Lino Lakes City Council approved the amendment on November 25. The Circle <br />Pines City Council rejected it on December 10 by a 4 -1 vote. The following evening, the <br />Centerville City Council also voted down the amendment by a 4 -1 vote. <br /> <br />The Steering Committee reconvened on December 12 to discuss other options . After <br />considerable discussion, the committee members agreed to continue its effort to find <br />resolution and unanimously approved a 30 -day extension of the withdrawal period to <br />allow the three cities more time to reach an agreement on voting procedures. <br /> <br />The proposed amendment to Section 11.1 of the CFD Joint Powers Agreement was <br />approved by the Circle Pines City Council on December 17 and by the Centerville City <br />Counc il on December 18. The proposed language reads as follows: <br /> <br />11.1 Notice. Member municipalities may withdraw from the District only in <br />accordance with this section. Notice to withdraw may only be given between <br />January 1, 2014 and January 30, 2014, or du ring the month of December in odd - <br />numbered years, beginning with December of 2015. Such notice shall provide a <br />minimum of two (2) years notice to the remaining municipalities of the intent to <br />withdraw. <br /> <br />Requested Council Direction <br /> <br />This item has been adde d to the special Council meeting following the work session for <br />consideration of approval.
