CITY COUNCIL <br />AGENDA ITEM 3A <br /> <br /> <br />STAFF ORIG INATOR: Jeff Karlson <br /> <br />MEETING DATE: December 19, 2013 <br /> <br />TOPIC: Amendment to CFD Joint Powers Agreement <br /> <br />VOTE REQUIRED: 3/5 <br /> <br /> <br />INTRODUCTION <br /> <br />The City Council is being asked to approve an amendment to Se ction 11.1 of the Centennial <br />Fire District Joint Powers Agreement. <br /> <br />BACKGROUND <br /> <br />On November 19 , 2013, the Centennial Fire District Steering Committee voted in favor of <br />having each member city’s council consider an amendment to Section 2.6 of the Joint Powe rs <br />Agreement, which would add the following language to the voting procedures: “However, <br />passage of a motion shall require an affirmative vote from one member of each member city.” <br /> <br />The Lino Lakes City Council approved the amendment on November 25 , 2013 . The Circle <br />Pines City Council rejected it on December 10 by a 4 -1 vote. The following evening, the <br />Centerville City Council also voted down the amendment by a 4 -1 vote. <br /> <br />The Steering Committee reconvened on December 12 to discuss other options. After <br />con siderable discussion, the committee members agreed to continue its effort to find resolution <br />and unanimously approved a 30 -day extension of the withdrawal period to allow the three cities <br />more time to reach an agreement on voting procedures. <br /> <br />The proposed amendment to Section 11.1 of the CFD Joint Powers Agreement was approved <br />by the Circle Pines City Council on December 17 and by the Centerville City Council on <br />December 18. The proposed language reads as follows: <br /> <br />11.1 Notice. Member municipalities may withdraw from the District only in accordance with <br />this section. Notice to withdraw may only be given between January 1, 2014 and January <br />30, 2014, or during the month of December in odd -numbered years, beginning with <br />December of 2015. Such notice shall provide a minimum of two (2) years notice to the <br />remaining municipalities of the intent to withdraw. <br /> <br />RECOMMENDATION <br /> <br />Approve amendment to Section 11.1 of the Centennial Fire District JPA as noted above.
