CITY COUNCIL AGENDA ITEM 3A STAFF ORIG INATOR: Jeff Karlson MEETING DATE: December 19, 2013 TOPIC: Amendment to CFD Joint Powers Agreement VOTE REQUIRED: 3/5 INTRODUCTION The City Council is being asked to approve an amendment to Se ction 11.1 of the Centennial Fire District Joint Powers Agreement. BACKGROUND On November 19 , 2013, the Centennial Fire District Steering Committee voted in favor of having each member city’s council consider an amendment to Section 2.6 of the Joint Powe rs Agreement, which would add the following language to the voting procedures: “However, passage of a motion shall require an affirmative vote from one member of each member city.” The Lino Lakes City Council approved the amendment on November 25 , 2013 . The Circle Pines City Council rejected it on December 10 by a 4 -1 vote. The following evening, the Centerville City Council also voted down the amendment by a 4 -1 vote. The Steering Committee reconvened on December 12 to discuss other options. After con siderable discussion, the committee members agreed to continue its effort to find resolution and unanimously approved a 30 -day extension of the withdrawal period to allow the three cities more time to reach an agreement on voting procedures. The proposed amendment to Section 11.1 of the CFD Joint Powers Agreement was approved by the Circle Pines City Council on December 17 and by the Centerville City Council on December 18. The proposed language reads as follows: 11.1 Notice. Member municipalities may withdraw from the District only in accordance with this section. Notice to withdraw may only be given between January 1, 2014 and January 30, 2014, or during the month of December in odd -numbered years, beginning with December of 2015. Such notice shall provide a minimum of two (2) years notice to the remaining municipalities of the intent to withdraw. RECOMMENDATION Approve amendment to Section 11.1 of the Centennial Fire District JPA as noted above.
