• <br />WS — Item #2 <br />WORK SESSION STAFF REPORT <br />Work Session Item #2 <br />Date: <br />To: City Council <br />From: Julie Bartell, City Clerk <br />Re: Peddler Regulations <br />Background <br />At the February 13, 2012 City Council some questions were posed during Open Mic <br />regarding the City's regulations on door to door peddling /soliciting. The council <br />requested that staff provide an update on the city's regulations. <br />Chapter 613 of the Lino Lakes Code of Ordinances entitled Transient Merchant, Peddler, <br />Canvasser and Solicitor contains the city's regulations. When a request is received to <br />sell in the city, we determine how the regulations will apply to the requested activity. <br />A commercial activity of selling goods or seeking orders either door to door or at <br />a fixed location as a transient merchant requires a city permit. The cost is $250 <br />for up to six months and the process is explained in the attached email; <br />- The regulations exclude certain activities (i.e. sales by school children, sales by <br />appointment) from the definition meaning that no city license is required; <br />Regulations exempt certain religious /charitable work from licensing but requires <br />that the organization submit information about their activities for city review; <br />- Individuals exercising their Constitutional rights (speech, press, religion) not in <br />conjunction with a commercial activity are exempted from city regulations; <br />The city allows the distribution of flyers door -to -door with a notification foam <br />submitted to the city (no knocking — just distribution allowed); <br />State statute allows the sale of products of the farm or garden occupied and <br />cultivated by the seller without a license. <br />Note that city policy requires that all individuals that fall under the city's regulations are <br />required to submit to a background check. <br />Requested Council Direction <br />No action is requested unless the council has interest in changing the current regulations. <br />Attachments <br />Peddler License Information <br />Chapter 613 of the Lino Lakes Code of Ordinances <br />P2 <br />
