1.5 Confidentiality /Data Practices Advisory <br />During the course of City employment, an employee will likely be asked to provide personal <br />information classified by state law as either private or confidential. Private data is information <br />that generally cannot be given to the public but can be given to the subject of the data. <br />Confidential data is information that generally cannot be given to either the public or to the <br />subject of the data. <br />The requested information will be used to evaluate the employee's job performance, eligibility, <br />and abilities. If the employee provides false, incomplete or misleading information, the <br />employee may be subject to discipline. <br />A. Types of Data <br />• Public Data. Information about a person that must be made available to the public or to <br />the subject of the data. <br />• Private Data. Information that can be given to the subject of the data upon request, but is <br />not available to the public without permission or as specifically authorized by law. <br />• Confidential Data. Information that generally cannot be given to the public or the subject <br />of the data. <br />• Personnel Data. Data on individuals collected because the individual is or was an <br />employee, an applicant for employment, performs service on a voluntary basis, acts as an <br />independent contractor with the City, or is a member of an advisory board, committee, or <br />commission. <br />• Summary Data. Data about a person used to develop statistics or reports are considered <br />public information, but the data does not identify any individual. <br />P. Public Personnel Data <br />With the exception of undercover law enforcement personnel, the following personnel data are <br />public: name, gross salary, salary range, gross pension, contract fee, benefits, expense <br />reimbursements, job title, job description, education and training background, previous work <br />experience, dates of employment, status of complaints or charges against employees, outcome of <br />complaints or disciplinary actions, work location, work telephone number, badge number, city <br />and county of residence. <br />C. Access to Personnel Files <br />Other persons or entities that are authorized by law to receive information in the employee's <br />personnel file are: <br />• Employees, agents and officials of the city who have a need to know about the <br />information in the course of their duties or responsibilities; <br />• The person who is the subject of private data; <br />• People who have permission from the subject of the data; <br />• The Internal Revenue Service and Minnesota Department of Revenue; <br />• The Immigration and Naturalization Service; <br />2 <br />
