8.8 Drug and Alcohol Testing <br />The City of Lino Lakes has a vital interest in maintaining safe, healthful, and efficient working <br />conditions for employees and recognizes that individuals who are impaired because of a <br />controlled substance jeopardize the health and safety of employees and the public. It is the policy <br />of the City to provide a drug and alcohol -free work environment. <br />A. Definitions <br />1. Collection Site. A place designated by the City where employees with commercial <br />driver's licenses present themselves for the purpose of providing a specimen of their urine <br />or to take a breath test to be analyzed for the presence of alcohol. <br />Controlled Substance. Those substances identified in 49 C.F.R. § 40.21(a), which <br />includes marijuana, amphetamines, opiates, (including heroin), phencyclidine (PCP), <br />cocaine, and any of their metabolites within this definition. <br />3. Commercial Motor Vehicle. A motor vehicle or combination of motor vehicles use in <br />commerce to transport passengers or property if the motor vehicle (1) has a gross <br />combination weight rating of 26,001 or more pounds inclusive of a towed unit with gross <br />weight rating of more than 10,000 pounds; or (2) has a gross weight rating of 26,001 or <br />more pounds; or (3) is designed to transport 16 or more passengers, including the driver; <br />or (4) is of any size and is used in the transportation of materials found to be hazardous <br />for the purposes of the Hazardous Materials Transportation Act. Fire trucks and other <br />emergency fire equipment are not considered commercial vehicles under this policy. <br />4. Confirmatory Test. A second controlled substance or alcohol test. For controlled <br />substance testing, a confirmatory test is a second analytical procedure to identify the <br />presence of a specific controlled substance or metabolite that is independent of the screen <br />test and uses a different technique and chemical principal in order to ensure reliability and <br />accuracy. For breath alcohol testing, the confirmatory test is a second breath alcohol test <br />following an initial breath alcohol test with an alcohol concentration of 0.02 or higher. <br />5. Initial Screening Test. An analytical procedure to determine whether an employee may <br />have a prohibited concentration of alcohol in his or her system. Initial breath alcohol <br />screening tests will be conducted by utilizing an evidential breath testing device (EBT) <br />that has met National Highway Traffic Safety Administration (NHTSA) specifications for <br />precision and accuracy. Initial blood alcohol screening tests will be conducted by the <br />laboratory in accordance with applicable law. In controlled substance testing, "initial <br />screening test" means an immunoassay screen to eliminate "negative" urine specimens <br />from further consideration. <br />6. Positive Test Result. A finding of the presence of alcohol or a controlled substance, or <br />their metabolites in the sample tested in levels at or above the threshold detection level. <br />7. Reasonable Suspicion. A basis for forming a belief based on specific facts and rational <br />inferences drawn from those facts. <br />8. Safety Sensitive Position. A job, including any supervisory or management position, in <br />which an impairment caused by drug or alcohol usage would threaten the health and <br />safety of any person. <br />35 <br />
