being contacted by the MRO or the MRO's staff representative, the test cannot be <br />reopened regardless of any explanation provided by the individual. <br />2. Notification of Negative Test Results. In the case of job applicants, Administration will <br />notify a job applicant verbally of a negative controlled substance result and the hiring <br />process will resume. A negative test results notification form will also be sent to the job <br />applicant. The job applicant may request a copy of the test result report from <br />Administration. <br />In the case of current employees, negative breath alcohol test results will be <br />communicated to employees immediately upon conclusion of the breath alcohol test. <br />Administration will verbally notify the employee and the employee's supervisor of a <br />negative blood alcohol or urine controlled substance test result. In all cases, a negative <br />test results notification form will also be sent to the employee. The employee may <br />request a copy of the test result report from Administration. The employee will receive <br />back pay for time lost and the City will not take any adverse action based on the negative <br />test result. <br />3. Notification of Positive Test Results. Positive breath alcohol test results will be <br />communicated to employees immediately upon conclusion of the breath alcohol test. In <br />the case of positive blood alcohol or urine controlled substance test results, the MRO will <br />contact the employee or job applicant to discuss the positive test result. <br />Within three work days of receiving a confirmed positive test notification from the MRO, <br />Administration will send to the supervisor and the employee or job applicant a positive <br />test results notification letter containing further instructions. The employee or job <br />applicant may contact Administration to request a copy of the test result report if desired. <br />4. Right to Provide Information After Receiving Test Results. Within three work days after <br />notice of a positive controlled substance or alcohol test result on a confirmatory test, the <br />employee or job applicant may submit information to the City or its MRO to explain the <br />positive result. If the employee or applicant has tested positive for controlled substance <br />use, the MRO may request the individual to indicate any over -the- counter or prescription <br />medication the individual is currently taking or has recently taken and any other <br />information relevant to the reliability of, or explanation for, the positive controlled <br />substance test result. <br />5. Right to Confirmatory Retest. In the case of urine controlled substance testing and blood <br />alcohol testing, a job applicant or employee may request a confirmatory retest of the <br />original sample at the job applicant's or employee's own expense after notice of a <br />positive test result on a confirmatory test. Within five work days after notice of the <br />confirmatory test result, the job applicant or employee must notify the City or its MRO, in <br />writing, of the job applicant's or employee's intention to obtain a confirmatory retest. <br />Within three work days after receipt of the notice, the City will notify the original testing <br />laboratory that the job applicant or employee has requested the laboratory to conduct the <br />confirmatory retest or transfer the sample to another laboratory licensed to conduct the <br />confirmatory retest. The original testing laboratory will ensure that the control and <br />custody procedures are followed during transfer of the sample to the other laboratory. <br />42 <br />
