• <br />Council Member introduced the following resolution and moved its <br />adoption: <br />CITY OF LINO LAKES <br />RESOLUTION NO. 12 -42 <br />RESOLUTION APPROVING AMENDMENT NO. 2 TO THE JOINT POWERS <br />AGREEMENT FOR THE RECONSTRUCTION OF COUNTY STATE AID HIGHWAY 14 <br />(MAIN STREET) AND I -35E INTERCHANGE <br />WHEREAS, Anoka County and the City of Lino Lakes previously entered into a joint powers <br />agreement for the turnback of Lilac Street. <br />WHEREAS, the City of Lino Lakes has previously received $300,000 from the County as <br />stipulated in the joint powers agreement. <br />WHEREAS, the City of Lino Lakes has requested Anoka County to include Lilac Street from <br />Sunset road to 4th Avenue with the County's 2012 Reclamation projects. <br />WHEREAS, the City of Lino Lakes agrees to refund the original $300,000 to the County and <br />fund any additional costs required to complete this project. <br />WHEREAS, Minnesota Statutes section 471.59 authorizes political subdivisions to enter into <br />joint powers agreements. <br />NOW, THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LINO <br />LAKES, MINNESOTA: The City Council hereby approves the amendment to the Joint Powers <br />Agreement with the County of Anoka for the pavement reclamation and installation of new <br />pavement on Lilac Street from Sunset Road to 4th Avenue and authorizes the Mayor and City <br />Clerk to execute said agreement on behalf of the City. <br />Jeff Reinert, Mayor <br />Julianne Bartell, City Clerk <br />Adopted by the Lino Lakes City Council this day of May, 2012. <br />The motion for the adoption of the foregoing resolution was duly seconded by Council Member <br />and upon vote being taken thereon, the following voted in favor thereof: <br />The following voted against same: <br />Whereupon said resolution was declared duly passed and adopted. <br />P36 <br />
