• <br />• <br />• <br />STAFF ORIGINATOR: <br />DATE: <br />TOPIC: <br />VOTE REQUIRED: <br />INTRODUCTION: <br />CITY COUNCIL <br />AGENDA ITEM lE <br />Julie Bartell, City Clerk <br />November 13, 2012 <br />Approve Application for Exempt Permit from Lawful <br />Gambling Permit for St. Joseph's Church <br />Simple Majority (3/5 Vote) <br />St. Joseph Catholic Church has applied for an exempt permit to conduct a raffle calendar in <br />2013. The proceeds from this fundraising event will be used to sponsor education and Knights <br />of Columbus charities at St. Joseph's of the Lakes Church. <br />BACKGROUND: <br />Non - profit organizations are allowed, under the State Gambling Statutes, to apply for an <br />exemption from a gambling license if they conduct five (5) or fewer gambling occasions per <br />calendar year. St. Joseph Catholic Church conducts five (5) or less per calendar and, therefore, <br />remains exempt from requiring a gambling license. In the case of a calendar raffle, all winners <br />are drawn on one single day but the names are announced throughout the year. <br />Minnesota Statutes, Chapter 349, Section 349.166, Subd. 2 requires that the non - profit <br />organizations applying for the exemption permit notify the city that they are applying for the <br />exemption and receive local approval. <br />The application and background materials are on file in City Clerk's office. <br />RECOMMENDATION: <br />Staff recommends that the City Council grant local approval to the application and that staff be <br />directed to forward the application to the Minnesota Gambling Control Board for final approval. <br />
