• • CITY OF LINO LAKES RESOLUTION NO. 12 -130 RESOLUTION APPROVING CONDITIONAL USE PERMIT TO ALLOW A MOTOR FUEL STATION AT THE PROPERTY LOCATED ON THE NORTHEAST CORNER OF LAKE DRIVE AND MAIN STREET WHEREAS, Grant Rademacher has submitted a request to the City for a conditional use permit to allow for the construction of a motor fuel station (Bill's Superette) located on the property located on the northeast corner of Lake Drive and Main Street; and WHEREAS, the legal description of the property (Subject Property) is: All of Lots 5, 6 and 7, Forest View Acres and those parts of the vacated service road and Lot 1, Forest View Acres, lying South of the North line of Lot 5 extended Westerly to the highway right of way, Anoka County, Minnesota and lying southeasterly of the northwesterly 30 feet of said Lot 1; and WHEREAS, staff has prepared a review of the plan set, dated September 7, 2012, most recently revised November 7, 2012; and WHEREAS, the Planning and Zoning Board held a public hearing on November 14, 2012 and unanimously recommended approval with conditions; and WHEREAS, the City Council of the City of Lino Lakes makes the following findings: a. The proposed development application has been found to be consistent with the policies and recommendations of the Lino Lakes Comprehensive Plan. b. The proposed development application is compatible with present and future land uses of the area. c. The proposed development application conforms to performance standards herein and other applicable City Codes subject to conditions of approval. d. Traffic generated by a proposed development application is within the capabilities of the City. e. The proposed use will not involve uses, activities, processes, materials, equipment and conditions of operation that will be detrimental to any persons, property, or the general welfare because of excessive production of traffic, noise, smoke, fumes, glare, or odors. f. The proposed use will not result in the destruction, loss, or damage of a natural, scenic or historic feature of major importance.
