CITY OF LINO LAKES <br />ORDINANCE 26 -04 <br />APPROVING REZONING FROM R -1 TO RESIDENTIAL PUD <br />FOR FOX DEN ACRES <br />The City Council of the City of Lino Lakes, Anoka County, Minnesota does ordain: <br />Section 1: Findings <br />The City Council makes the following findings regarding the application for rezoning the <br />property described below, based on the factors listed in Section 2, Subd.l E of the Lino Lakes <br />zoning ordinance: <br />1. Royal Oaks Realty submitted an application for an amendment to the zoning ordinance to <br />rezone land to Planned Unit Development (PUD). The currently zoning of the site is R -1, <br />Single Family Residential. <br />The proposal includes platting the site as Fox Den Acres. <br />3. The proposed action has been considered in relation to the specific policies and provisions of <br />and has been found to be consistent with the official City Comprehensive Plan, as the site is <br />guided for Low Density Sewered Residential uses and is within the existing Metropolitan <br />Urban Service Area. <br />4. The proposed use is compatible with present and future land uses of the area. The site is <br />guided for Low Density Sewered Residential use. Land to the west is guided for similar use <br />and is developed as a single family neighborhood. Land to the north is a regional park <br />reserve. Existing and anticipated future land uses in the area are considered compatible with <br />the proposed uses. <br />5. Upon compliance with the conditions of approval set forth in Resolution 04 -196, the <br />proposed uses will conform with all performance standards contained in the zoning ordinance <br />and other requirements. <br />6. The proposed use can be accommodated with existing public services and will not <br />overburden the City's service capacity. Utilities are currently available to the site and there <br />is ample capacity for the addition of eight homes. <br />• 7. Traffic generation by the proposed use is within capabilities of streets serving the property. <br />
