• AGENDA ITEM 1D <br />• <br />• <br />STAFF ORIGNINATOR: <br />MEETING DATE: <br />TOPIC: <br />Jean Viger, Deputy Clerk <br />February 14, 2005 <br />Consider Approving Application for Exempt <br />Permit, St. Joseph Catholic Church <br />VOTE REQUIRED: Simple Majority (3/5 Vote) <br />BACKGROUND: <br />St. Joseph Catholic Church is planning its annual Ham Bingo event to take place on <br />Sunday, March 20, 2005. <br />All lawful gambling conducted in Minnesota requires authorization from the Minnesota <br />Gambling Control Board in the form of a license, exempt permit or excluded <br />authorization. An exempt permit may be issued to non - profit organizations conducting <br />lawful gambling activity on five or fewer days during a calendar year. St. Joseph <br />Catholic Church, 171 Elm Street, conducts fewer than five and is not required to secure a <br />gambling license. <br />Minnesota Statute, Chapter 349, Section 349.166, Subd. 2 does, however, require that the <br />non - profit organizations applying for the exemption permit notify the City. The City <br />must than take action on the application. <br />A copy of the application for the exempt permit, the certificate of general liability and the <br />results of the background check are on file in the city clerk's office. <br />OPTIONS: <br />1. Adopt a motion approving the application. <br />2. Deny the application. <br />RECOMMENDATION: <br />Option No. 1 <br />
