City Council <br />JPA Anoka County <br />February 28, 2005 <br />D. Upon completion of 50% of the work on the transportation- related portion of the AUAR, <br />the City shall bill the County for one -half of the estimated cost of the project to that point in <br />time, not to exceed $22,500 based on the actual consultant contract awarded. Upon <br />completion of the transportation- related issues of the AUAR, the City shall bill the County <br />for the remaining one -half of the estimated cost of the plan, not to exceed $22,500, based on <br />the actual consultant contract awarded. Total billing of the County by City will not exceed <br />$45,000 in accordance with item B, above. County agrees to submit payment to City within <br />sixty (60) days of receipt of each bill. <br />TERM <br />This agreement shall continue until terminated as provided hereinafter. <br />DISBURSMENT OF FUNDS <br />All funds disbursed by each party pursuant to this Agreement shall be disbursed by each <br />entity pursuant to the method provided by law. <br />VI. CONTRACTS AND PURCHASES <br />All contracts and purchases made pursuant to this Agreement shall be disbursed by City <br />in conformance to the State Laws. <br />STRICT ACCOUNTABILITY <br />A strict accounting shall be made of all funds and reports of all receipts and <br />disbursements shall be made upon request by any party. <br />TERMINATION <br />This agreement may be terminated by any of the parties at any time, with or without <br />cause, upon not less than thirty (30) days written notice delivered by mail or in person to the <br />other parties. If notice is delivered by mail, it shall be deemed to be received two (2) days after <br />mailing. Such termination shall not be effective with respect to any solicitation of bids or any <br />purchases of services or goods which occurred prior to such notice of termination. Each party <br />shall pay its pro rata share of costs which City incurred prior to such notice of termination. <br />IX. AFFIRMATIVE ACTION <br />In accordance with the County's Affirmative Action Policy and the County <br />Commissioners' policies against discrimination, no person shall illegally be excluded from full - <br />time employment rights in, be denied the benefits of, or be otherwise subjected to discrimination <br />in the program which is the subject of this Agreement of the basis of race, creed, color, sex, <br />marital status, public assistance status, age, disability or national origin. <br />X.
