• <br />DATED February_, 2005 <br />MEMORANDUM OF UNDERSTANDING <br />FOR THE RECONSTRUCTION OF COUNTY STATE AID HIGHWAY 14 (MAIN <br />STREET) BETWEEN I -35 W AND I -35 E IN THE CITIES OF CENTERVILLE AND <br />LINO LAKES, MINNESOTA <br />This Memorandum of Understanding (MOU) is between the County of Anoka, State of Minnesota, a political <br />subdivision of the State of Minnesota, 2100 Third Avenue North, Anoka, Minnesota, 55303, hereinafter <br />referred to as "County ", and the City of Lino Lakes, a municipal corporation i erthe laws of the State <br />of Minnesota, 600 Town Center Parkway, Lino Lakes, Minnesota 55014 hereinafter referred to as the <br />"City ". <br />The parties to this MOU agree in principle that construction of County -State Project No. 02- 614 -24 and City <br />Project No _ collectively referred to as the "Project" i's;,,in "the best interest of the traveling <br />public and that the Preliminary Layout as shown in Exhibit "A" defines the design of the Project. <br />It is agreed that the Exhibit "A" Layout dated February _,.2005 has been reviewed and accepted by the <br />parties and is suitable for preparation of final construction documents.-Any significant changes made <br />hereafter to the design as presented in the Exhibit "A" Layout will require approval by the parties as an <br />amendment to this MOU or addressed in a separate Joint Powers Agreement (JPA) that will formalize this <br />MOU. These same changes will require a change in the cost share to include_any additional design <br />engineering cost that may occur. <br />INTERSECTIONS: <br />As agreed by the parties, improvements to following City Street intersection have been incorporated in the <br />Exhibit "A" Layout designer 4: <br />1. WOODLAND AVE:- <br />2. 21st Avenue. N <br />It is understood that futureimproverients may be required at the CSAH 14 and 21st Avenue N intersection to <br />accommodate improvementsor'the future= interchange at I -35 E. It is agreed by the parties that the left turns <br />at the 21St; Avenue N intersection7may be closed to improve future capacity and safety of the highway. It is <br />agreed by the parties that the median along CSAH 21 (20th Avenue N) and County Road 54 is a design <br />element that significantly improves „safety along the corridor and is necessary for the future capacity of the <br />highway. It is understood that future improvements will need to be made to CSAH 21 and County Road 54 <br />in the future as development occurs. Improvements include but are not limited to: turn lanes, through lanes, <br />extension of concrete me'dtanMi is understood that the County reserves the right to extend the concrete <br />medians as shown on Exhibit "A” thereby reducing full access points to right in/right out accesses. The costs <br />of these improvements Will be determined at the time of construction and are expected to be shared by the <br />County, City and Developer. <br />RIGHT OF WAY: <br />The parties agree that the County will acquire all necessary right -of -way and easements for the Project. <br />Acquisition of any additional right -of -way and/or easements needed for the improvements to the City street <br />intersections beyond what is defined in the Exhibit "A" Layout will be the responsibility of the City. The <br />parties agree that parcels, ,as µhown on Anoka County' '1 ' No, 4A ac`l edlszE clubit B ,);' required for the <br />project that are owned by the City will be conveyed to the County at no cost to the County.
