Consideration of 1St Reading of Ordinance <br />08 -05 <br />Vacation of North Road and Street and Utility Easement <br />(Old TH49) <br />Rice Lake Professional Center <br />E.G. Rud and Sons Surveying <br />Simple Majority <br />E.G. Rud and Sons Surveying has requested approval of a Preliminary and Final Plat for <br />property located adjacent to the northeast corner of Lake Drive and Hodgson Road. The <br />applicant has already obtained Site and Building Plan Review approval administratively on July <br />18, 2005; executed a performance agreement for the site; and has pulled building permits for <br />construction of a 25,000 square foot multi- tenant building on the site. The applicant is now <br />pursuing a Preliminary and Final Plat to clarify the legal descriptions and easement <br />documentation on the subject property. The subject site was purchased from the City of Lino <br />Lakes earlier this year. <br />A portion of the site is encumbered with right of way from North Road and a Street and Utility <br />Easement for the old alignment of Trunk Highway 49. Both North Road and Trunk Highway 49 <br />were realigned in 1995. The applicant is requesting vacation of the North Road right -of -way and <br />the TH 49 street and utility easements. The applicant will dedicate new utility easements in <br />conjunction with the Final Plat of the site. <br />ANALYSIS <br />As stated both North Road (east of Lake Drive) and TH 49 north of Hodgson Road were <br />removed as part of a realignment project constructed by the City in 1995. However the road <br />right -of -ways and easements were never vacated. The City does maintain an existing storm <br />sewer in the North Road right -of -way as well as trunk sanitary sewer and water main within the <br />old TH 49 alignment. <br />Do to the 1995 street realignment the North Road right -of -way lying east of Lake Drive is no <br />longer needed for street purposes. The former TH 49 street easement lying north of Hodgson <br />Road and the centerline of North Road is no longer needed street purposes. <br />Public Utilities exist within both these corridors. New easements covering the existing utilities <br />will be dedicated as part of the Final Plat. <br />
