STAFF ORIGINATOR: <br />CITY COUNCIL <br />MEETING DATE: <br />TOPIC: <br />AGENDA ITEM 6J <br />Michael Grochala <br />September 12, 2005 <br />Consideration of Resolution No. 05 -140 <br />Accepting Metropolitan Council Conditions for <br />Receipt of LCA Demonstration Grant <br />ACTION REQUIRED: Simple Majority <br />BACKGROUND <br />In December of 2000 the Metropolitan Council awarded the City a $450,000 Livable <br />Communities Act (LCA) Demonstration Account Grant. The grant agreement included a <br />condition that the City install a traffic signal on the northbound off -ramp of I -35W <br />(consistent with approval of the City's Comprehensive Plan Amendment and MUSA <br />exchange for Behm's Century Farm). <br />Staff has requested payment of the grant amount as part of the Legacy at Woods Edge <br />project. However, because the signal has not been installed, an amendment to the LCA <br />contract is required to allow payment prior to the installation of signals. Metropolitan <br />Council is proposing to amend the agreement subject to the following condition: <br />1. The City agrees to reimburse the Metropolitan Council by January 31, 2008 <br />the entire $450,000 grant amount if a traffic signal is not installed on the <br />northbound off -ramp of I -35W and operational by December 31, 2007. <br />As the City Council is aware final design for the improvements to Lake Drive and the I- <br />35W interchange is underway as part of the Legacy at Woods Edge project. The City <br />was successful in obtaining $400,000 from the Minnesota Department of Transportation <br />(Mn /DOT) Cooperative Agreement program to assist with the improvements. Funding <br />for the City's share of the improvements are provided for within the Legacy at Woods <br />Edge Development Contract and TIF agreement. <br />While the City is currently seeking federal funding for the improvement of Lake Drive <br />and the Interchange itself, we will be in a position to complete the signalization <br />improvements prior to the December 31, 2007 deadline. <br />RECOMMENDATION <br />Staff is recommending approval of Resolution No. 05 140. <br />
