AGENDA ITEM 1B <br />STAFF ORIGNINATOR: Jean Viger, Deputy Clerk <br />MEETING DATE: September 12, 2005 <br />TOPIC: Consider Resolution 05 -128 Approving <br />Application for Exempt Permit to PACE (Paper, <br />Allied - Industrial, Chemical & Energy) Workers <br />International Union, Local #7 -0264 <br />VOTE REQUIRED: Simple Majority (3/5 Vote) <br />BACKGROUND: <br />PACE, Local #7 -0264 is planning a gun raffle in conjunction with its 10th Annual Golf <br />Tournament. The tournament is being held at Chomonix Golf Course on Saturday, <br />September 17, 2005. <br />All lawful gambling conducted in Minnesota requires authorization from the Minnesota <br />Gambling Control Board in the form of a license, exempt permit or excluded <br />authorization. An exempt permit may be issued to non - profit organizations conducting <br />lawful gambling activity on five or fewer days during a calendar year. PACE holds just <br />this one tournament each year. <br />Minnesota Statute, Chapter 349, Section 349.166, Subd. 2 does, however, require the <br />non - profit organization applying for the exempt permit to notify the City. The City must <br />than take action to approve the application, approve with a 30 day waiting period or deny <br />the application. <br />On August 9, 2005, the applicant inadvertently sent the completed application to the <br />Minnesota Gambling Control Board rather than to the City of Lino Lakes. Because the <br />event is scheduled to take place September 17, 2005, the application, if approved, must <br />be approved with no waiting period. The signed copy will then be faxed to the Minnesota <br />Gambling Control Board. <br />The application, proof of non - profit status and all other required information is on file in <br />the city clerk's office. <br />OPTIONS: <br />1.
