• <br />• <br />• <br />Rice Lake Professional Center, page 3 <br />CITY OF LINO LAKES <br />ORDINANCE NO. 08 -05 <br />AN ORDINANCE VACATING NORTH ROAD RIGHT -OF -WAY AND <br />STREET AND UTILITY EASEMENT <br />(RICE LAKE PROFESSIONAL CENTER) <br />The City Council of the City of Lino Lakes, Anoka County, Minnesota does ordain: <br />Section 1 Findings <br />The City Council makes the following findings regarding the application to vacate an public <br />right -of -way and existing street and utility easement: <br />1. E. G. Rud and Son's Land Surveying, the owner of property abutting North Road east of <br />Lake Drive and a certain street and utility easement lying north of Hodgson Road and South <br />of the centerline of North Road as legally described in Exhibit A, attached hereto and made a <br />part hereof, has requested the City Council to vacate such Road and Street and Utility <br />Easements according to law. <br />A public hearing was held on September 12, 2005 before the City Council in the city hall on <br />such request after due published and posted notice had been given, as well as personal notice <br />to affected property owners by the clerk on August 25th 2005 and all persons interested were <br />given an opportunity to be heard; <br />3. The applicant is dedicating to the public, as part of the Final Plat for Rice Lake Professional <br />Center, all necessary easements; <br />4. It appears that it will be in the best interest of the city to approve such request <br />Section 2 <br />Such request is hereby granted and that part of North Road lying easterly of Lake Drive and the <br />Street and Utility Easement (Document No. 993102) lying north of Hodgson Road and South of <br />the centerline of North Road, described as follows is hereby vacated: <br />Exhibit A <br />Section 4 <br />That any person, corporation or city owning or controlling easements contained upon the <br />property vacated reserves the right to continue maintaining the same or to enter upon such way <br />or portion thereof vacated to maintain, repair, replace, remove or otherwise attend thereto. <br />
