AGENDA ITEM 1C <br />STAFF ORIGNINATOR: Jean Viger, Deputy Clerk <br />MEETING DATE: October 10, 2005 <br />TOPIC: Consider Approving Application for Exempt <br />Permit, St. Joseph Catholic Church <br />VOTE REQUIRED: Simple Majority (3/5 Vote) <br />BACKGROUND: <br />St. Joseph Catholic Church has applied for an exempt permit to conduct a raffle at their <br />annual Venison Feed to be held on November 22, 2005. The proceeds from this <br />fundraising event will be used to award college scholarships to members of St. Joseph <br />Catholic Church high school seniors. Non - profit organizations are allowed, under the <br />State Gambling Statutes, to apply for an exempt from gambling license if they conduct <br />fewer than five (5) gambling occasions per calendar year. St. Joseph Catholic Church <br />conducts fewer than five (5) gambling events per calendar and, therefore, remains exempt <br />from requiring a gambling license. A copy of the application is attached. <br />Minnesota Statute, Chapter 349, Section 349.166, Subd. 2, requires the non - profit <br />organization applying for the exemption permit to notify the city. The city must sign the <br />application acknowledging the request and state the action taken. <br />A copy of the application is on file in the city clerk's office. <br />OPTIONS: <br />1. Approve the application <br />2. Deny the application <br />RECOMMENDATION: <br />Option No. 1 <br />
