CITY OF LINO LAKES <br />RESOLUTION NO. 26-17 <br />APPROVING 2245 TELE DRIVE 3-SEASON PORCH SETBACK VARIANCE <br />WHEREAS, the City received a land use application for 2245 Tele Drive 3-season porch <br />setback variance; and <br />WHEREAS, City staff completed review of the proposed variance based on the following <br />submittals: <br />• Applicant Narrative <br />• Survey prepared by Lot Surveys Company, Inc. dated June 24, 1997 <br />• Construction Plans; and <br />WHEREAS, the legal description of the property addressed 2245 Tele Drive is Lot 7, <br />Block 2 Clearwater Creek 2nd Addition; and <br />WHEREAS, the applicant is proposing to construct a 16' x 16' 3-season porch off the <br />back of the existing house. The lot is a corner lot. The rear lot line is opposite the front lot line <br />along Tele Drive. The rear lot line is not parallel to the front lot line; and <br />WHEREAS, the property is zoned R-1, Single Family Residential. The required rear lot <br />line principal building setback is 30ft. The 3-season porch is considered part of the principal <br />building. Per the survey submitted with the variance application, the northeast corner of the <br />porch will encroach 3.5ft into the required 30ft setback. The northwest corner of the porch will <br />not encroach into the setback. No portion of the porch encroaches into the drainage & utility <br />easement; and <br />WHEREAS, the Planning & Zoning Board reviewed and recommended approval of the <br />variance on January 14, 2026. <br />NOW, THEREFORE BE IT RESOLVED by the City Council of Lino Lakes, Minnesota that: <br />FINDINGS OF FACT <br />Per City Code Section 1007.018(3)(a) Criteria and findings of fact. No variance shall be granted <br />unless it meets all the criteria in divisions 1. through 6. below, or unless division 7. below <br />applies. The city shall make findings regarding compliance with these criteria. <br />1. The variance shall be in harmony with the general purposes and intent of this chapter. <br />
