<br />Variance <br />This staff report is based on the following submittals: <br />Applicant Narrative <br />Survey prepared by Lot Surveys Company, Inc. dated June 24, 1997 <br />Construction Plans <br />ANALYSIS <br /> The applicant is proposing to construct a 16’ x 16’ 3-season porch off the back of the existing <br />house. The lot is a corner lot. The rear lot line is opposite the front lot line along Tele Drive. The <br />rear lot line is not parallel to the front lot line. <br />Zoning and Setback Requirements <br />The property is zoned R-1, Single Family Residential. The required rear lot line principal building <br />setback is 30ft. The 3-season porch is considered part of the principal building. Per the survey <br />submitted with the variance application, the northeast corner of the porch will encroach 3.5ft <br />into the required 30ft setback. The northwest corner of the porch will not encroach into the <br />setback. No portion of the porch encroaches into the drainage & utility easement. <br /> The applicant notes in the narrative that the “resident’s desired design cannot shift east or west <br /> due to the existing windows and doors currently on the house”. <br />Option <br />A smaller 3-season porch could be constructed that meets setback requirements. <br />Criteria and Findings of Fact <br />Per City Code Section 1007.018(3)(a) Criteria and findings of fact. No variance shall be granted <br />unless it meets all the criteria in divisions 1. through 6. below, or unless division 7. below <br />applies. The city shall make findings regarding compliance with these criteria. <br />1.The variance shall be in harmony with the general purposes and intent of this chapter. <br />City Code Section 1007.000(2) details the purpose and intent of Chapter 1007: Zoning Code. The <br />variance is in harmony with the general purposes and intent of this chapter. <br />2.The variance shall be consistent with the official City Comprehensive Plan. <br />Per the Comprehensive Plan, the property is guided for Low Density Residential land use. <br />2 <br /> <br />
