described in Exhibit A be acquired, if necessary, through use of the power of eminent domain; and WHEREAS, via Resolution 25-176 adopted by the City Council on December 8, 2025, the City Council authorized the acquisition of the necessary property interests shown in City of Lino Lakes Right of Way Plat No. 4 via the power of eminent domain; and WHEREAS, subsequently the City discovered a small overlap in three abutting parcels shown in City of Lino Lakes Right of Way Plat No. 4; and WHEREAS, the City has therefore revised City of Lino Lakes Right of Way Plat No. 4 to incorporate Parcel 3 & 4 and Parcel 3 & 5 into the plat; WHEREAS, the City Council adopted the final version City of Lino Lakes Right of Way Plat No. 4 by Resolution No. 26-26; and WHEREAS, the City Council finds, given the need to submit the project to bid in the spring of 2026, that the use of the quick -take procedures in Minnesota Statutes section 117.042 is necessary so the title may be in place prior to bidding and wishes to adopt an amended resolution incorporating the final version of City of Lino Lakes Right of Way Plat No. 4. NOW, THEREFORE, BE IT RESOLVED by the City Council of Lino Lakes, Minnesota that: 1. The property interests described in City of Lino Lakes Right of Way Plat No. 4, attached hereto as Exhibit A, attached hereto and made a part hereof as though fully set forth at this point, shall be acquired for the stated public purposes, and that the interests shall be acquired, if necessary, through the exercise of the power of eminent domain. 2. City staff, City consultants, and the law firm of Squires, Waldspurger & Mace, P.A. are authorized and directed to take all steps necessary on behalf of the City to fulfill the purposes of this resolution and to acquire the property interests described herein by serving a notice of quick -take under Minn. Stat. § 117.042, together with other required documents, and filing an action in eminent domain if necessary. 3. The City's legal counsel and representatives are authorized to remove any property listed in Exhibit A from the eminent domain proceedings if the City settles with the property owners between the adoption of this resolution and the filing of a petition in district co u rt. 4. All actions taken to date by City staff, City consultants, and the City's legal counsel in furtherance of the acquisition of the necessary property interests shown in Exhibit A are hereby ratified by the City Council.
