WS — Item 6 <br />WORK SESSION STAFF REPORT <br />Work Session Item No. 6 <br />Date: April 4, 2011 <br />To: City Council <br />From: Jeff Karison <br />Julie Bartell <br />Jean Viger <br />Re: Sign Ordinance <br />Background <br />The City Council approved the first reading of Ordinance No. 08 -11 on March 14. The <br />Council discussed the odd year municipal election calendar, including the absentee <br />balloting period, and moved to amend the ordinance to allow for a 30 -day period for <br />election signs prior to the City's municipal election. <br />Staff has since been informed by the city attorney that MN Statute 203B.081 requires that <br />the City's municipal election calendar include a 46 -day absentee balloting period prior to <br />the November election. Because of this information, the second reading of the ordinance <br />was pulled from the March 28 Council agenda. <br />Staff contacted the Secretary of State's Office and received a written response on March <br />31 confirming that the absentee voting period is 46 days for "all regularly scheduled <br />elections." The time period for signs does not necessarily have to match the absentee <br />ballot period, but then you would have people voting absentee before election signs are <br />allowed to be posted. <br />Staff will add the second reading of the ordinance to the April 11 Council agenda. <br />Requested Council Direction <br />Staff is recommending that the Council adopt the second reading of the ordinance by <br />allowing a 46 -day time period for election signs to be consistent with even year elections. <br />Attachments <br />Memo from City Attorney Joe Langel <br />Email Correspondence from Secretary of State's Office <br />Minn.
