Structural encroachment shall not be allowed on any drainage and utility easement unless <br />the following criteria apply to said property: <br />1. The easement is not currently for underground utility purposes. <br />2. The drainage will not be affected by the approved structure or other encroachment <br />on the easement. <br />B. The encroachment construction is done at the property owners own risk. If drainage <br />and /or utility improvements on this easement become a problem in the future, the <br />property owner(s) may be required by the City to remove the easement structure and <br />regrade the easement, at the property owner(s) expense. <br />C. All other requirements of the Zoning Ordinance are enforced. This agreement shall <br />become a part of the property record and apply to all present and future property owners. <br />The placement of the approved structure or other encroachment shall be located in <br />accordance with the Certificate of Survey, attached he e to as xhibit A <br />OWNER <br />
