P93 <br />Council Member introduced the following resolution and moved its <br />adoption: <br />CITY OF LINO LAKES <br />RESOLUTION NO. 11 -99 <br />RESOLUTION APPROVING A <br />SITE IMPROVEMENT PERFORMANCE AGREEMENT AND AN <br />OPERATION AND MAINTENANCE AGREEMENT FOR STORMWATER <br />TREATMENT FEATURES FOR 7997 LAKE DRIVE <br />WHEREAS, the Motor Fuel Station at 7997 Lake Drive wishes to construct a new <br />canopy and pump island, and; <br />WHEREAS, on October 10, 2011 the City Council adopted Resolution Number 11 -95, <br />approving a Conditional Use Permit Amendment, and <br />WHEREAS, a Site Improvement Performance Agreement is required for all <br />development projects, and <br />WHEREAS, the previous Operation and Maintenance Agreement for Stormwater <br />Treatment Features did not include new stormwater facilities to be created with the <br />proposed construction. <br />NOW, THEREFORE, BE IT RESOLVED that the Lino Lakes City Council hereby <br />approves a new Site Improvement Performance Agreement (ATTACHMENT A) and a <br />new Operation and Maintenance Agreement for Stormwater Treatment Features <br />(ATTACHMENT B) for 7997 Lake Drive. <br />Jeff Reinert, Mayor <br />ATTEST: <br />Julianne Bartell, City Clerk <br />Adopted by the Lino Lakes City Council this 10th day of October, 2011. <br />The motion for the adoption of the foregoing resolution was duly seconded by Council <br />Member and upon vote being taken thereon, the <br />following voted in favor thereof: <br />The following voted against same: <br />Whereupon said resolution was declared duly passed and adopted <br />
