• <br />• <br />• <br />STAFF ORIGINATOR: <br />MEETING DATE: <br />TOPIC: <br />VOTE REQUIRED: <br />BACKGROUND: <br />AGENDA ITEM 1E <br />Julie Bartell, City Clerk <br />October 24, 2011 <br />Consider Approving Application for Exempt <br />Permit from Lawful Gambling License for St. <br />Joseph Catholic Church ((calendar raffle) <br />Simple Majority (3/5 Vote) <br />St. Joseph Catholic Church has applied for an exempt permit to offer a raffle calendar in <br />2012. The proceeds from this fundraising event will be used to sponsor education and <br />Knights of Columbus charities at St. Joseph's of the Lakes Church. <br />Non - profit organizations are allowed, under the State Gambling Statutes, to apply for an <br />exemption from a gambling license if they conduct five (5) or fewer gambling occasions <br />per calendar year. St. Joseph Catholic Church conducts five (5) or Tess per calendar <br />and, therefore, remains exempt from requiring a gambling license. In the case of a <br />calendar raffle, all winners are drawn on one single day but the names are announced <br />throughout the year. <br />Minnesota Statutes, Chapter 349, Section 349.166, Subd. 2 requires that the non - profit <br />organizations applying for the exemption permit notify the city that they are applying for <br />the exemption and receive local approval. <br />The application and background materials are on file in City Clerk's office. <br />OPTIONS: <br />1. Adopt a motion approving the application for exemption with no waiting period <br />2. Deny the application for exemption. <br />RECOMMENDATION: <br />Option No. 1 <br />
