City of Lino Lakes, Hearing on Mr. Sawh's motion to modify <br />17 stay — Mayor Reinert read a statement indicating that the special meeting was being held to consider <br />18 the request of Mr. Sawh to consider his motion to modify the terms of the stay of disposition of his <br />19 dog Brody. He read a brief summary of the proceedings and decisions regarding the matter to date. <br />20 (recording on file). The mayor noted that neither Mr. Sawh nor his attorney were present. <br />21 <br />22 <br />23 <br />24 <br />25 <br />26 <br />27 <br />28 <br />29 <br />30 The mayor noted that he is not inclined to allow the dog back into any Lino Lakes neighborhood. It's <br />31 bitten three times, including once inside the home. It has also bitten at the impound spot. <br />32 <br />33 Council Member O'Donnell moved to deny the motion based on the finding of fact. Council Member <br />34 Roeser seconded the motion. Motion carried on a unanimous voice vote. <br />35 <br />36 ADJOURN <br />37 <br />38 There being no further business, Council Member Gallup moved to adjourn at 5:50 p.m. Council <br />39 Member Rafferty seconded the motion. Motion carried on a unanimous voice vote. <br />40 <br />41 These minutes were considered and approved at the regular Council Meeting, October 24, 2011. <br />42 <br />43 <br />44 Julianne Bartell, City Clerk Jeff Reinert, Mayor <br />45 <br />Attorney Monge explained the purpose of the council meeting and the council's options to act — to <br />deny the motion or grant the motion. The council's decision should be based upon balancing the <br />interest of Mr. Sawh in having the stay modifyed and the public interest in continuing to confine the <br />animal to the Otter Lake animal facility. He presented documents for the record: Mr. Sawh's letter <br />requesting modification of the stay; two letters sent to Mr. Sawh's attorney notifying him of the date <br />and time of the meeting; proposed findings of fact denying the motion to modify. He added that Mr. <br />Sawh is standing on the prior submissions to the council regarding this matter. <br />1 <br />
