• Authorizes sale of malt liquor for consumption on the premises (or <br />adjacent) to one brewery location owned by the brewer; <br />• Only small brewers (brewing no more than 250,000 barrels of malt liquor <br />annually) qualify for a brewer taproom license; <br />• The brewery can, if it chooses, operate a restaurant at the brewery. <br />• The brewer is limited to one taproom license; <br />• Fee to be imposed by the city; <br />• Authorizes the brewer to only sell /serve their brewed product; <br />• If the brewer wishes to be open and serve on Sunday, a Sunday sales <br />license would be required. <br />2. Lino Lakes Zoning Ordinances <br />Lino Lakes City Ordinances currently address the following: <br />a) A brewery (bottling establishment) only needs state licensing. Breweries <br />do not need a City liquor license to manufacture beer. Cities regulate <br />brewery locations through their Zoning Ordinances. Lino Lakes Zoning <br />Ordinance lists "Bottling establishments to include beverages such as soft <br />drinks, milk, etc, but not including hazardous or toxic materials" in its <br />Industrial zones. <br />• The City would amend the Industrial Zone ordinance to clarify the <br />definition of "bottling ". The City would incorporate all aspects of the <br />operation to include a brewery where beer is also available on tap. <br />b) "Liquor sales, on and off - sale" are a permitted use in Limited Business <br />and General Business commercial zoning districts. The Neighborhood <br />Business zoning ordinance allows "Liquor Sales: on -sale wine and malt <br />liquor (beer) only, off -sale 3.2 percent malt liquor (beer) only." <br />• The City will need to amend the ordinance to clarify that a "brewpub" <br />which includes a restaurant is an allowable use in Commercial zones. <br />Recommendation <br />If the City Council wishes to add this type of city license to its liquor code and amend the <br />zoning ordinances, staff should be directed to prepare an amendment to the city liquor <br />code as well as determine the appropriate fee, and move that forward. Staff should be <br />directed to prepare the zoning amendments, which could be brought to the Planning & <br />Zoning Board in December. <br />Attachments: <br />1.
