• • • CITY OF LINO LAKES ORDINANCE NO. 01-02 ORDINANCE ACCEPTING A PERMANENT DRAINAGE EASEMENT AND VACATING PART OF AN EXISTING DRAINAGE AND UTILITY EASEMENT ON LOT 1, BLOCK 10, LAKES ADDITION NO. 3 THE CITY COUNCIL OF THE CITY OF LINO LAKES DOES HEREBY ORDAIN: Section 1 The City Council makes the following findings: 1. The Lakes Addition No. 3 plat was approved by the Village of Lino Lakes in 1973. Utility and drainage easements around the lot perimeters, 10 feet wide, were dedicated and recorded as part of that plat. 2. On March 27, 1989, the Lino Lakes City Council granted an "easement variance" and vacation of a portion of an easement on Lot 1, Block 10, Lakes Addition No. 3 to allow a house to be built closer to the lot lines than would be allowed by the easements around the perimeter of the lot (Attachment A). No easement vacation was ever recorded. 3. A house has been built within the existing 10' easements. 4. It is necessary to vacate a portion of the existing 10' easements to finalize the action taken in 1989 but never recorded. 5. A separate drainage and utility easement was to be dedicated in 1999 covering the southeastern portion of Lot 1, Block 10. This easement was not recorded. 6. The City has received an new document dedicating this easement to the City (Attachment B). It is necessary to accept this easement and record it. Section 2 The City Council hereby accepts an easement for pond and flowage purposes described as: Than part of Lot 1, Block 10, Lakes Addition No. 3 lying southeasterly of a line described as follows: commencing at the northeast corner of said lot; thence westerly along the northerly line of said lot 83.00 feet to the beginning of the line to be described; thence deflecting to the left 53° 0' 00" a distance of 86.00 feet; thence deflecting to the right 29° 35'52" a distance of 49.34 feet to the southwest corner of said lot, and said described line there terminating.
