616 <br />STAFF ORIGINATOR: John Miller, City Planner <br />Ord. 01-02 <br />AttachmentA DATE: March 20, 1989 <br />Page 3 <br />AGENDA ITEM 7 11 <br />TOPIC: Vacation of easements, granting a variance for <br />lots purchased by Roger Nelson <br />BACKGROUND: <br />The city has attempted to sell tax forfeit lots found in <br />Lakes Addition No. 2 and No. 3, located on Black Duck Drive. <br />Roger Nelson, the person who submitted the high bid, has <br />asked for some setback variances and easement vacations that <br />would allow him to locate houses closer to the street. The <br />planning and zoning board recommended denial on a 3 -2 vote. <br />OPTIONS: <br />1.. Approve variances and vacate easements to coincide with <br />the reduced variances as follows: <br />A. Five foot front yard total setback for Lot 1 Block <br />and Lot 6 -8, Block 10. <br />fl A. 10 <br />B. Ten foot front yard total setback for Lots 2 -7, <br />Block 7. <br />Fives foot :south <br />Block <br />ive ; ,feet° north side yard <br />Block 10. <br />side yard total setback for Lot 6, <br />total <br />setback.for'Lot <br />2. Deny the variances and easement vacations. This action <br />would probably make the lots unbuildable and kill the <br />sale to Nelson <br />RECOMMENDATION' <br />1. Approve the variances and vacate the easements (Marilyn <br />Anderson has the exact legal descriptions) as requested <br />by Nelson. <br />2. Make sure Nelson is aware this approval does not include <br />removal of borrow material for any outlots. <br />
