• <br />COUNCIL MINUTES <br />JANUARY 14, 2002 <br />Councilmember Dahl stated she would be willing to vote in favor of the amended ordinance if <br />phasing requirements were included. Councilmember Carlson noted both developers in attendance <br />this evening have agreed to the phasing of their developments. <br />City Attorney Hawkins noted Mr. Coyle has asked that 25 acres of the Uhde development be <br />exempted from the moratorium and that the rest would be subject to the new regulations. He stated <br />he would prefer the ordinance be amended to allow plats of up to 25 acres submitted by the <br />established deadline to be exempted from the moratorium and the rest of the applications be <br />withdrawn. He stated if the Council were to simply require the remainder of the applications to <br />comply with the new regulations he was not certain this would be legally enforceable. <br />Mayor Bergeson expressed concern for requiring the developers to withdraw their applications and <br />reapply with a different number of acres. He noted if the amended ordinance was approved this <br />evening, this would not allow this opportunity. City Attorney Hawkins indicated the developers <br />could amend their plats without being required to submit,new applications. <br />th <br />Community Development Director Grochala suggested the uncilallow either the complete <br />applications to move forward as submitted or not allow any port pps`of the applications to move <br />forward. He felt there would be problems with amending the applications since he prefers sites to be <br />master planned versus piece - mealed together. <br />Community Development Director Grochalanoted there was an issue of how the goal of 147 <br />residential developments per year would apply to these developments if the Comprehensive Plan is <br />not in effect yet. He questioned, if the Couctl;allowed the developers to move forward with 25 <br />acres, would those acres apply to thatgoal He1tthese issues must be clarified and he would not <br />want to be back before the Coupfcii in twd,tp three months recommending denial of the applications <br />due to some issue that was nit clarified this = evening. <br />Councilmember Carlson noted the motion was approved to amend the ordinance allowing the plats <br />received as of the adoption of the ordinance to move forward. Community Development Director <br />Grochala stated if the Council approves the ordinance as amended, he would recommend that the <br />applications stand as submitted. <br />Councilmember Carlson noted the new Comprehensive Plan discusses phasing large developments <br />and the plats that would be covered by the amended ordinance include a total of 288 units. She <br />believed the Council and the developers were in agreement with the phasing of those developments <br />and asked how this can be accomplished for this year. <br />Mayor Bergeson suggested that the new exemption in the ordinance be amended to limit the number <br />of units or acres that can be developed in one year under that exemption. <br />Mr. Coyle stated the preliminary plat submitted last Wednesday included a five phase process, which <br />would begin with the requested 25 acres. He suggested that Mr. Weiland make this same type of <br />commitment as well. <br />19 <br />
