• The effects of intensive motorized watercraft use in shallow lake areas is also well <br />documented. <br />The proposed ordinance would establish a no -wake zone lying north of the southern <br />section lines of Section 10 and 11, Township 31 N, Range 22W starting at the southern <br />boundary of Rehbeins Peltier View Subdivision of Lino Lakes (Attachment 1). The <br />defined area, as proposed, is generally consistent with a 500 -meter buffer around the <br />bird nesting habitat. The no wake zone would be in effect 24 hours a day all year. <br />Regulating the use of Lakes in Minnesota is delegated to local governments. <br />Regulation is achieved through local ordinance establishment. There are two local <br />governments involved in the issue of regulating use on Lake Peltier. They are the Cities <br />of Lino Lakes and Centerville. As part of the ordinance adoption process, the two cities <br />will need to pass a joint powers agreement (JPA). The JPA is an agreement between <br />the two cities to jointly adopt and enforce the ordinance requirements. <br />Anoka County would be responsible for posting and notification of this area on the Lake. <br />The Anoka County Sheriff's Department and the DNR Conservation office would be <br />responsible for the enforcement of this ordinance. A letter of support for adoption of the <br />ordinance, from Anoka County, is attached for council review. <br />The Peltier Lake Association met on March 4, 2002 to discuss this issue. Staff <br />• understands that the association is proposing a modification of the proposed no wake <br />zone that would be acceptable to association members. Staff would welcome any <br />modifications that alleviate association member concerns while still addressing the <br />stated environmental concerns. <br />• <br />OPTIONS <br />1. Approve the Joint Powers Agreement with the City of Centerville and approve the 1st <br />Reading of Ordinance 03 -02 regulating the surface use of motorized watercraft on <br />Peltier Lake in the Peltier Lake Island area. <br />2.
