• CITY OF LINO LAKES RESOLUTION NO. 02-45b RESOLUTION DENYING APPROVAL OF A VARIANCE FROM THE MINIMUM LOT SIZE FOR PROPERTY IN AN R -X, RURAL EXECUTIVE ZONING DISTRICT AND A MINOR SUBDIVISION FOR PROPERTY LOCATED AT 901 OAK LANE WHEREAS, the City has received an application for a Variance and Minor Subdivision of property legally described to -wit: Lot 28 and 29, Block 2, Lakeview Woodlands, Anoka County, Minnesota and WHEREAS, the City's zoning ordinance and subdivision regulations provide for and establish requirements for Variances and Minor Subdivisions, and WHEREAS, the proposed Variance and Minor Subdivision would result in the creation of property of less than 10 acres in size, in violation of Section 5, subd. 2.B.1 of the Lino Lakes Zoning Ordinance, which requires a minimum lot size of 10 acres for property in an R -X zone, and WHEREAS, The Lino Lakes City Council makes the following findings of fact: 1. The property has been, and is currently being, put to a reasonable use as the property site for the applicants home. 2. There are no unique physical circumstances associated with the lot. 3. The Variance and Minor Subdivision are motivated by the desire to sell the proposed lot. 4. The R -X, Rural Executive District requires a minimum lot size of 10 acres. Creating a buildable parcel with less than the required minimum lot size in not generally available to other properties within the R -X District. 5. City Ordinance states a minimum lot size of 10 acres in an R -X zone. NOW, THEREFORE BE IT RESOLVED THAT Lino Lakes City Council denies the proposed Variance and Minor Subdivisions as described by the attached document entitled "Certificate of Survey, Lots 28 & 29, Block 2, Lake View Woodlands" by Kurth Surveying & Engineering, Inc., dated April 21, 2002. Adopted by the Lino Lakes City Council this 28th day of May, 2002.
