• <br />CITY OF LINO LAKES <br />RESOLUTION NO. 02-45b <br />RESOLUTION DENYING APPROVAL OF A VARIANCE FROM THE <br />MINIMUM LOT SIZE FOR PROPERTY IN AN R -X, RURAL EXECUTIVE <br />ZONING DISTRICT AND <br />A MINOR SUBDIVISION FOR PROPERTY LOCATED <br />AT 901 OAK LANE <br />WHEREAS, the City has received an application for a Variance and Minor Subdivision <br />of property legally described to -wit: <br />Lot 28 and 29, Block 2, Lakeview Woodlands, Anoka County, Minnesota <br />and <br />WHEREAS, the City's zoning ordinance and subdivision regulations provide for and <br />establish requirements for Variances and Minor Subdivisions, and <br />WHEREAS, the proposed Variance and Minor Subdivision would result in the creation <br />of property of less than 10 acres in size, in violation of Section 5, subd. 2.B.1 of the Lino <br />Lakes Zoning Ordinance, which requires a minimum lot size of 10 acres for property in <br />an R -X zone, and <br />WHEREAS, The Lino Lakes City Council makes the following findings of fact: <br />1. The property has been, and is currently being, put to a reasonable use as the property <br />site for the applicants home. <br />2. There are no unique physical circumstances associated with the lot. <br />3. The Variance and Minor Subdivision are motivated by the desire to sell the proposed <br />lot. <br />4. The R -X, Rural Executive District requires a minimum lot size of 10 acres. Creating <br />a buildable parcel with less than the required minimum lot size in not generally <br />available to other properties within the R -X District. <br />5. City Ordinance states a minimum lot size of 10 acres in an R -X zone. <br />NOW, THEREFORE BE IT RESOLVED THAT Lino Lakes City Council denies the <br />proposed Variance and Minor Subdivisions as described by the attached document <br />entitled "Certificate of Survey, Lots 28 & 29, Block 2, Lake View Woodlands" by Kurth <br />Surveying & Engineering, Inc., dated April 21, 2002. <br />Adopted by the Lino Lakes City Council this 28th day of May, 2002. <br />
