AGENDA ITEM 6H <br />STAFF ORIGINATOR: John Powell, City Engineer <br />COUNCIL MEETING DATE: January 24, 2000 <br />TOPIC: Public Hearing — First Reading, Ordinance No. 17 -99, Easement <br />Vacation, Oak Brook Peninsula. <br />VOTE REQUIRED: 4/4 Vote Required <br />BACKGROUND: <br />At the January 10, 2000, City Council meeting, this Public Hearing was opened and <br />continued. City staff has not received any new or additional information to present. <br />Based on the most recent correspondence received from the RCWD and the DNR, and <br />the discussion above, City staff recommends vacation of the requested portion of the <br />easement with the following conditions: <br />1. The easement must be expanded to encompass the areas below the 912.9 contour <br />and the existing pond. <br />2. An easement must be provided over the drainage swale from the Schwartz property <br />to the pond. <br />3. The swale must be re- graded and restored to provide a three foot wide bottom, 4:1 <br />sideslopes, and positive slope away form the Schwartz property. An as -built survey <br />of the swale must be provided to the City. An as -built survey showing the rink does <br />not impound Schwartz runoff must also be provided. <br />4. The deadline for completion of the above items is March 15, 2000. <br />5. The hockey rink must comply with all applicable City ordinances as determined by a <br />formal Site Plan review by the City. Further conditions regarding use of the rink may <br />be imposed during the Site Plan review process. <br />OPTIONS: <br />1. Approve the first reading of Ordinance No. 17 -99 with the conditions noted. <br />2. Approve the first reading of Ordinance No. 17 -99 with other conditions. <br />3. Continue the Public Hearing to a future date. <br />4. Do not approve the first reading of Ordinance No. 17 -99. <br />RECOMMENDATION: <br />Option 1 - Approve the first reading of Ordinance No. 17 -99. <br />
