AGENDA ITEM 6 A <br />STAFF ORIGINATOR: Mary Kay Wyland <br />DATE: January 24, 2000 <br />TOPIC: Martha Houle /Herman Zuettel, 1600 Birch Street, Minor <br />Subdivision <br />VOTE REQUIRED: 3/4 Vote <br />DESCRIPTION OF REQUEST: <br />This case involves a request for a minor subdivision of the property on the south /west <br />corner of Birch Street and Centerville Road. The site is approximately 40 acres in size <br />and zoned Rural. The existing land use map indicates the site as rural. The draft <br />comprehensive plan guides the property for rural development through 2010 and <br />low /medium density residential on the western edge and commercial on the eastern edge <br />some time after 2010. There are considerable wetlands on the parcel, particularly on the <br />eastern edge along Centerville Road. <br />A single family home is under construction on the north/west corner of the parcel. The <br />property is jointly owned by a brother and sister who have had some difficulty deciding <br />how to split the parcel equitably. However, after much negotiation they have agreed on <br />the submitted plan that would split the site into two parcels. Parcel A would contain 15 <br />acres and contain the home currently under construction, Parcel B would contain 24.9 <br />acres. Both parcels will meet the Zoning Ordinance requirement calling for a minimum <br />of 10 acres and 330' of lot frontage. Staff would recommend approval of this split with <br />the following conditions: <br />1. An additional 27' of right of way for Centerville Road shall be dedication to <br />Anoka County along the easterly border of the parcel. <br />2. The single family home currently under construction on the westerly parcel <br />must connect to City water with the understanding that there is a deferred <br />assessment on the balance of the property payable upon future development of <br />the site. This differed assessment shall also apply to the newly created Parcel <br />B and also be payable upon future development of that site. NOTE: The <br />council previously approved a site plan review to allow a home to be moved <br />onto this parcel with the above mentioned condition. After moving the home <br />on to the site the applicant decided to abort that plan and construction a new <br />dwelling. <br />3. Any development on the easterly parcel shall require Park Dedication as <br />outlined in the Subdivision Ordinance <br />
