He stated that he shares <br />the concern expressed by Ms. Lane and does not believe a buffer strip such as this would <br />be appropriate for this lake. He advised of the education that has been occurring <br />regarding the damage caused by fertilizers and progress made in that regard Chair Schaps <br />stated this is a recreational lake and he does not believe this condition would be fair to <br />impose on the applicant. <br />Mr. Corson suggested that during the construction period they be required to place silt <br />fence to eliminate sedimentation into the lake. Mr. Vanderlik stated they would not object <br />but do intend to start construction shortly so there may be some problem with installing <br />silt fence posts into the frozen ground. He stated it is their intent to leave the surrounding <br />ground natural but it is the property owner's decision with regard to what happens to the <br />groundcover after construction. He noted that this land has very little slope. <br />Mr. Corson noted that the erosion control could be installed in the newly placed fill which <br />would not be frozen. <br />Chair Schaps suggested the applicant talk with several of the neighbors regarding the high <br />water level. <br />Ms. Lane noted the comment from the DNR saying they do not object subject to the lake <br />setback being maximized and placing the vegetation buffer. Mr. Smyser explained that the <br />DNR approved the City's Shoreline Ordinance but the City does have the authority to <br />grant the variance. He advised that staff will prepare a supplemental report to convey the <br />Boardmember's comments regarding the buffer to the City Council. <br />Ms. Lane made a MOTION to approve the variance request to allow construction of a <br />single - family home at 6750 West Shadow Lake Drive within 100 feet of the Ordinary High <br />Water Level of Reshanau Lake based on findings as indicated and on the following <br />conditions: <br />1. The home is constructed at the 30 -foot front setback line with a varied lake <br />setback of 71 feet to 84 feet. <br />2. A revised survey document is provided for building permit purposes. <br />The MOTION was supported by Mr. Johnson. Motion carried 6 -0. <br />This item will go before the City Council Monday, February 14, 2000, 6:30 p.m. <br />E.
