MEETING DATE: April 10, 2000 <br />TOPIC: Final Plat, Highland Meadows West <br />VOTE REQUIRED: 3/5 <br />BACKGROUND <br />The amended preliminary plat for Highland Meadows West was approved on January 10, <br />2000. This planned development includes lots for single family detached homes and <br />quad townhomes. <br />The City Attorney has reviewed the title information. The development agreement is <br />being finalized as this report is being written. We expect the agreement to be completed <br />in time for the City Council meeting, including the financial securities. <br />The conditions approved with the preliminary plat are being addressed. Most of the <br />conditions require actions that will take place as part of the development activity or after <br />the final plat is approved. Where possible, we incorporated the conditions into the <br />development agreement. <br />One of the trails that will be dedicated to the City runs in a powerline easement. We are <br />requiring that the developer provide an agreement with the Hutchinson Utilities <br />Commission that allows the trail. The developer submitted the attached draft agreement <br />that has been reviewed by the City Attorney. As part of the development agreement, the <br />developer will get the signature of the Hutchinson Utilities Commission later this month. <br />The agreement will then be recorded. <br />The existing 79th St. on the site is in a 33 -ft road easement. An easement vacation is <br />necessary and has been applied for. We have included this vacation requirement in the <br />developer's agreement. <br />OPTIONS <br />1. Approve final plat. <br />2. Approve trail encroachment agreement contingent on Hutchinson Utilities <br />Commission approval. <br />3. Return to staff with direction. <br />RECOMMENDATION <br />Options 1 and 2 <br />
