STAFF ORIGINATOR: <br />MEETING DATE: <br />TOPIC: <br />AGENDA ITEM NO. 3E <br />Ry -Chel Gaustad, CMC City Clerk - Treasurer <br />May 22, 2000 <br />Authorize New Liquor Club License for the <br />American Legion Post 566 <br />VOTE REQUIRED: Simple Majority <br />BACKGROUND: <br />Attached find an application for a Club Liquor License submitted by Bob Moser. As you <br />may be aware, the old Police Department (7731 Lake Drive) was purchased on August 9, <br />1999, by the American Legion. Their plans are to complete the remodeling of this <br />building and to be prepared for business effective July 1, 2000. However, prior to being <br />open for business both a Cabaret and Club Liquor License are required. <br />Investigator Matt Vana conducted a background criminal investigation on Robert Moser <br />and Terrance Randall and found no problems (Please see attached memorandum). Also <br />attached find a copy of the certificate for dram shop insurance. <br />In accordance with the City Code, 701. Liquor Licensing. Section .02 Subd. 5 Club <br />License the American Legion qualifies for a Club Liquor License. The Club License <br />shall be issued only to incorporated clubs which have been in existence for fifteen years <br />or more, or to congressionally charged chartered veterans' organizations which have been <br />in existence for ten years, and shall permit on -sale of liquor to members and bona fide <br />guests only. <br />In keeping within the City Code guidelines, a condition of the license is that this license <br />should not be granted to the American Legion for operation for which taxes, assessments <br />or other financial claims of the city are delinquent and unpaid. This is not the case <br />however, be aware that the SAC fee has been added to the American Legion tax roll & is <br />in good standing. <br />The applicant is fully aware license approval is subject to all the provisions and <br />conditions of the laws of the city, state and of the federal government. <br />
