• <br />• <br />• <br />AGENDA ITEM 3A <br />STAFF ORIGINATOR: Ry -Chel Gaustad, CMC City Clerk <br />MEETING DATE: June 12, 2000 <br />TOPIC: 2000 Liquor License Renewals <br />VOTE REQUIRED: Simple Majority (3/5 Vote) <br />BACKGROUND: <br />This item involves two issues, the 49 Club's liquor license renewal and the results of <br />Shirley Kaye's and 49 Club's criminal background checks. <br />Attached is a memo regarding criminal and contact checks on Shirley Kaye's and the 49 <br />Club. The memo illustrates that both stated businesses failed liquor compliance checks. <br />In light of the findings, the City should follow the process stated in the city code, for both <br />businesses. <br />City Code reads: <br />The council may, after notice and hearing, suspend or revoke any liquor license <br />for violation of any provision or condition of this chapter or any state law or <br />regulation governing the sale of intoxicating liquor and shall revoke such license <br />if the licensee willfully violates any provision of this chapter or any state law or <br />regulation governing the sale of intoxicating liquor. <br />Staff recommends establishing a hearing date of Wednesday, August 2, 2000 at the <br />regularly scheduled council work session. <br />Previously, the Council approved all liquor licenses with the exception of the 49 Club. <br />The State Alcohol and Gambling Enforcement Division requires a review process prior to <br />issuance of the license. Staff verified that the 49 Club has paid taxes and the license <br />renewal fee for year 2000. Staff is requesting Council direction either to approve or deny <br />the renewal application. <br />
