• <br />• <br />• <br />UPDATED <br />AGENDA ITEM 6A <br />STAFF ORIGINATOR: John Powell, City Engineer <br />COUNCIL MEETING DATE: June 26, 1999 <br />TOPIC: PUBLIC HEARING - Resolution No. 00 -64, Adopt Assessment Roll, Twilight <br />Acres 1st and 2nd Additions <br />VOTE REQUIRED: Simple Majority <br />BACKGROUND: <br />On May 8, 2000, the City Council set the Public Hearing for the proposed assessments for <br />the Twilight Acres 1st and 2nd Addition Utility and Street Improvement project for June 12, <br />2000. The hearing was opened and continued to June 26 in order to provide notice to the <br />property owners in accordance with State statutes. The necessary notices have been mailed <br />to property owners indicating the amount of the assessment and the date of the hearing. <br />They have also received a copy of the entire assessment roll for their subdivision. <br />Summaries of the project costs and assessments, as well as the actual assessment rolls, are <br />attached. <br />The proposed assessments are based on the project costs. Appraisals for the properties to <br />be assessed could not be prepared in time for the project to proceed this construction <br />season. The actual amount which can be assessed to each property cannot exceed the <br />benefit to the property as defined by State statute. After the assessment hearing is held, and <br />the proposed assessment is adopted, the property owners have 30 days to appeal the <br />assessment amounts. Only after the appeal period expires, and the City is able to determine <br />the funding to be derived from assessments, will the City be able to consider award of the <br />contract. <br />OPTIONS: <br />1. Return to staff for further review. <br />2. Adopt Resolution No. 00 -64 adopting the assessment roll for the Twilight Acres 1st and <br />2nd Addition project. <br />RECOMMENDATION: <br />Staff recommends Option No. 2, the adoption of Resolution 00 -64. <br />
