Agreement provided such Agreement shall not be terminated by <br />operation of law, and provided action to enforce such specific <br />performance shall be commenced within six (12) months after such <br />right of action shall arise. <br />4. Special Assessments and Real Estate Taxes <br />The parties shall pay in. full .all unpaid special assessments <br />against the property for all public improvements, levied, pending <br />or assessed as of this Purchase Agreement. It is the intention of <br />the Parties that assessments due as the result of the Centennial <br />Middle School Street and Utility Improvement, City of Lino Lakes, <br />shall . be the responsibility of new property owners. Exhibit "B ", <br />attached represents the approximate assessments each party will <br />assume upon completion of this Purchase Agreement. Real Estate <br />taxes due and payable in 1996 shall be pro -rated to the date of <br />closing. <br />5. Mutual Warranties. <br />A. The parties agrees to deliver possession prior to closing <br />provided that all conditions of this Agreement are being complied <br />with. <br />B. The parties have received no notice and have no knowledge <br />of any pending notice of a violation of any statues, ordinances, <br />regulations, judicial decrees or orders, nor the pendency of any <br />lawsuits, administrative or arbitration hearing, or governmental <br />investigations, or proceedings affecting the property and the use <br />thereof. <br />C.
