• <br />• <br />Council Member <br />introduced the following ordinance and moved its adoption. <br />CITY OF LINO LAKES <br />ORDINANCE NO. 10 -00 <br />AN ORDINANCE ESTABLISHING A MORATORIUM ON THE PERMITTING AND <br />CONSTRUCTION OF NEW TOWER STRUCTURES FOR THE PROVISION OF <br />PERSONAL WIRELESS SERVICES <br />The City Council of the City of Lino Lakes, Anoka County, Minnesota does hereby ordain: <br />Section 1. Findings <br />The City Council finds that current demand for personal wireless services in the metropolitan <br />area is creating the need for new antenna locations. The antennae may be located on buildings, <br />water towers, and other tall structures, including towers constructed specifically for the antennae. <br />The City Council finds further that a study is warranted to examine the demand for new towers <br />and the potential tower sites for provision of personal wireless services. The purpose of the <br />study is to create a plan of how best to provide for the provision of personal wireless services <br />while minimizing the number of tower structures and protecting the public health, safety, and <br />welfare. <br />The City Council finds, therefore, that a moratorium is required in order to protect the planning <br />process and to prevent the construction of new towers pending the completion of the study and <br />the consideration and, if necessary, implementation of new regulations. <br />Section 2. Moratorium Established <br />In accordance with the findings set forth in this ordinance and pursuant to the authority of <br />Minnesota Statutes 462.355 Subd. 4, there is hereby established a moratorium on the permitting <br />and construction of new personal wireless services towers within the City. <br />During the period of the moratorium, applications for new towers shall not be accepted by the <br />City nor shall any building permits for such work be issued. For the purposes of the moratorium, <br />the term "tower" shall mean "any ground mounted pole, spire, structure, or combination thereof, <br />including supporting lines, cables, wires, braces, masts, intended primarily for the purpose of <br />mounting an antenna or similar apparatus above grade." <br />Section 3. Applicability <br />The moratorium shall be applicable to property throughout the City. The moratorium applies <br />only to new tower structures for personal wireless services. <br />
