AGENDA ITEM 8A STAFF ORIGINATOR: John Powell, City Engineer COUNCIL MEETING DATE: August 14, 2000 TOPIC: PUBLIC HEARING - Resolution No. 00 -64, Adopt Assessment Roll, Twilight Acres 1St and 2nd Additions VOTE REQUIRED: Simple Majority BACKGROUND: The Public Hearing for this item is continued from the July 24, 2000, City Council meeting. Many residents made statements and asked questions about the proposed assessment amounts, the Public Improvement process (Statute 429), and the City Charter. Specific information from the City Attorney and Charter Commission was requested in order to clarify the 60 -day waiting period status. City staff has received and attached opinions from both the City Attorney and the Chair of the Charter Commission regarding this issue. A resident also indicated he had contacted the Metropolitan Council and the Minnesota Pollution Control Agency and received assurance there were funds available for this type of project. City staff again contacted both of these agencies and the Minnesota Department of Health regarding grant funding availability specifically to help pay assessments for connection to City utilities. We were unable to identify alternative funding sources. Many of the funding sources relate to replacement of on -site systems, low interest loans, or have income restrictions. The first meeting of the Twilight Acres Work Group regarding the septic systems was held Thursday evening, August 10 with several residents, the City Administrator and myself attending. The group specifically asked that the following issues be considered: 1. Another survey to determine the level of the resident's willingness to pay for this project. 2. Placing the project on the ballot this Fall for consideration. 3. Making a specific funding request to an agency other than the City. 4. Modifying the project to include alternative means of providing utility service. City staff will need time to investigate these issues and report to the City Council. We recommend continuing the public hearing at least until the August 28, 2000 meeting. OPTIONS: 1. Continue the Public Hearing to the August 28, 2000 City Council meeting. 2. Do not adopt the assessment roll for the Twilight Acres 1st and 2nd Addition project. 3. Adopt the assessment roll for the Twilight Acres 1st and 2nd Addition project. RECOMMENDATION: Option 1 — Continue the Public Hearing for Adoption of the Assessments for the Twilight Acres 1st and 2 "d Addition project to the August 28, 2000 City Council meeting.
