AGENDA ITEM 8A <br />STAFF ORIGINATOR: John Powell, City Engineer <br />COUNCIL MEETING DATE: August 14, 2000 <br />TOPIC: PUBLIC HEARING - Resolution No. 00 -64, Adopt Assessment Roll, Twilight Acres 1St <br />and 2nd Additions <br />VOTE REQUIRED: Simple Majority <br />BACKGROUND: <br />The Public Hearing for this item is continued from the July 24, 2000, City Council meeting. Many <br />residents made statements and asked questions about the proposed assessment amounts, the <br />Public Improvement process (Statute 429), and the City Charter. Specific information from the City <br />Attorney and Charter Commission was requested in order to clarify the 60 -day waiting period status. <br />City staff has received and attached opinions from both the City Attorney and the Chair of the Charter <br />Commission regarding this issue. <br />A resident also indicated he had contacted the Metropolitan Council and the Minnesota Pollution <br />Control Agency and received assurance there were funds available for this type of project. City staff <br />again contacted both of these agencies and the Minnesota Department of Health regarding grant <br />funding availability specifically to help pay assessments for connection to City utilities. We were <br />unable to identify alternative funding sources. Many of the funding sources relate to replacement of <br />on -site systems, low interest loans, or have income restrictions. <br />The first meeting of the Twilight Acres Work Group regarding the septic systems was held Thursday <br />evening, August 10 with several residents, the City Administrator and myself attending. The group <br />specifically asked that the following issues be considered: <br />1. Another survey to determine the level of the resident's willingness to pay for this project. <br />2. Placing the project on the ballot this Fall for consideration. <br />3. Making a specific funding request to an agency other than the City. <br />4. Modifying the project to include alternative means of providing utility service. <br />City staff will need time to investigate these issues and report to the City Council. We recommend <br />continuing the public hearing at least until the August 28, 2000 meeting. <br />OPTIONS: <br />1. Continue the Public Hearing to the August 28, 2000 City Council meeting. <br />2. Do not adopt the assessment roll for the Twilight Acres 1st and 2nd Addition project. <br />3. Adopt the assessment roll for the Twilight Acres 1st and 2nd Addition project. <br />RECOMMENDATION: <br />Option 1 — Continue the Public Hearing for Adoption of the Assessments for the Twilight Acres 1st and <br />2 "d Addition project to the August 28, 2000 City Council meeting. <br />
