Planning & Zoning Board <br />August 14, 2002 <br />Page 11 <br />APPROVED MINUTES <br />Motion failed for lack of a second. <br />Mr. Rafferty made a MOTION to table Donald Lindahl, 855 Ash Street, Minor <br />Subdivision & Variance for one month for additional findings. <br />The motion was supported by Mr. Hyden. <br />Motion carried 5-0. <br />D.PUBLIC HEARING – JADT Development, Lino Lakes Commercial Center, SE <br />corner of Lake Drive and Apollo Drive In tersection, Preliminary Plat & Site Plan <br />Review/CUP accessory drive-thru <br />Chair Schaps opened the Public Hearing at 7:33 p.m. <br />Staff stated JADT Developm ent Group, LLC. has requested preliminary plat approval to <br />allow a four lot, commercial subdivision (JADT Addition) on property located east of <br />County Road 23 between Apollo Drive and I-35W. <br />Staff indicated the subject 7.0 acre developm ent overlays Outlot B of the Lino Lakes <br />Commercial Development (PDO) which was approved last year. <br />Staff noted in conjunction with the prelim inary plat request, th e applicant is also <br />requesting site and building plan approval to allow the construction of a 14,172 square <br />foot retail strip center upon proposed Lot 4 of the subdivision and a conditional use <br />permit to allow a drive-thru facility. <br />Staff stated the subject prop erty is zoned SC, Shopping Center with a PDO, Planned <br />Development Overlay (to allow various design flexibilities). <br />Staff presented its analysis by explaining the Access to three of th e four lots (Lots 1 <br />through 3) will be provided via an existing private street located east the adjacent <br />McDonald’s site. While the Ordinance requ ires all lots be pr ovided access via a public <br />street access, flexibility to this requireme nt can be accommodated via the PDO. As part <br />of the City’s previous consideration of the McDonald’s proposal, a determination was <br />made that access to the subject property would be provided by the existing private street. <br />Staff noted a cross easement and operation and maintenance agreement will be required <br />as part of the Development Agreement. <br />Staff stated the SC District requires a minimum lot size of three acres. Through the PDO <br />however, flexibility to this requirement can be provided without need for a variance. As <br />shown on the preliminary plat, the proposed lots range in size from 1.7 to 2.3 acres. As <br />demonstrated via the submission of site plans, the configuration of the proposed lots are <br />conducive to future commercial development.
