CONTINUED PUBLIC HEARING to consider amending the Z oning <br />Ordinance to add requirements for Temporary Outdoor Sales, Farmer’s <br />Markets, and Community Gardens <br /> <br /> <br />Chair Tralle declared the Public Hearing open at 6:34 p.m. <br /> <br />Associate Planner, Paul Bengtson, presented the sta ff report. Staff recommended <br />approval of the zoning ordinance amendments. <br /> <br />Staff clarified the intent of a license versus a pe rmit. Staff stated that the requirements of <br />a license would be more specific, and would include review by the City Clerk and a <br />background check of the applicant. A permit would allow something without a fee, but <br />may have some basic requirements. <br /> <br />Mr. Laden made a MOTION to Close the Public Hearing at 6:45 p.m. Motion was <br />supported by Mr. Hyden. Motion carried 5-0. <br /> <br />Mr. Nelson made a MOTION to recommend approval of t he zoning amendments <br />regarding temporary outdoor sales, farmer’s markets and community gardens. Motion <br />was supported by Mr. Hyden. Motion carried 5 - 0. <br /> <br />Mr. Tralle called a recess at 6:46 p.m. for adminis trative purposes. <br /> <br />Chair Tralle reconvened the meeting at 6:48 p.m. <br /> <br /> <br />VI. DISCUSSION ITEMS <br /> <br />A. Recreational Facilities in Residential and Rural Di stricts <br /> <br />Mr. Smyser stated that the city has received compla ints by residents regarding the riding <br />of motorcycles on a man-made dirt track on a proper ty located in the R-1, Single Family <br />Residential, zoning district. <br /> <br />Staff discussed the issue with the city attorney. The city’s view is that an off-road <br />racing/riding course is not comparable to other all owable uses in a residential zone. <br /> <br />Staff is seeking the opinion of the P&Z Board befor e discussion with the City Council. <br />Staff asked for direction on whether the board feel s that this should be an allowable use <br />in the Residential or the Rural zones. <br /> <br />Following discussion, P&Z Board Members were of the opinion that the issue at hand is <br />not a land use issue, but a noise nuisance issue th at should be addressed.
