CONTINUED Variance from the Ordinary High Water Level to allow for the <br />reconstruction of an accessory structure located at 1801 77 th St. <br /> <br />Paul Bengtson, Associate Planner, presented the sta ff report. Staff recommended denial <br />of the variance request, due to the findings of fac t. <br /> <br />Mr. Bengtson stated that Mr. Marier had provided do cumentation from the county that <br />his parcel is five acres in size. <br /> <br />Ron Marier, 1801 77 th St., stated that he revised the plan, removed the request for a porch <br />cover, and was willing to reduce the size of an acc essory structure if necessary to obtain <br />the variance. He noted that the garage is the most important piece to allow for handicap <br />access to the property. <br /> <br />Mr. Nelson made a MOTION to recommend approval of t he Variance from the OHWL <br />to allow for the reconstruction of an accessory str ucture located at 1801 77 th St. subject to <br />the following condition: <br /> <br />1. Prior to certificate of occupancy for the addition, the property owner must submit <br />proof that the accessory buildings on site have bee n reduced to a maximum of 4,200 <br />square feet in area. <br /> <br />Motion was supported by Mr. Root. Motion carried 4 - 0. <br /> <br />B. PUBLIC HEARING to Amend the Planned Unit Develo pment for Legacy at <br />Woods Edge to amend the signage standards within Ch apter 5 of the Lino Lakes <br />Town Center Design and Development Guide. <br /> <br />Mr. Bengtson presented the staff report. Staff rec ommended approval of the amendment <br />request. <br /> <br />Mr. Hyden arrived at 6:52 p.m. <br /> <br />Mr. Tralle opened the Public Hearing at 6:53 p.m. No one was present to speak. <br /> <br />Mr. Root made a MOTION to close the Public Hearing at 6:54 p.m. Motion was <br />supported by Mr. Laden. Motion carried 4-0. <br /> <br />Mr. Laden made a MOTION to approve the amendment to the Town Center Design and <br />Development Guide to allow user tenants to have thr ee wall signs. Motion was supported <br />by Mr. Nelson. Motion carried 4-0. <br /> <br />C. Final Plat for Marketplace 3 rd Addition for a commercial subdivision lot line <br />adjustment. <br /> <br />Mr. Bengtson presented the staff report. Staff not ed that the city attorney approved of the <br />plat as presented. Staff recommended approval of t he Final Plat. <br />
