We have also received comments from the Air Park <br />Association indicating this proposed location is optimum for several reasons outlined in <br />their letter. The main consideration is the 7/1 transition airspace required from the <br />runway which could not be achieved if the structure were located behind the home as <br />required by the Ordinance. For this reason Staff believes there is a hardship and would <br />recommend approval of the variance request. <br />For Council information we are considering an Ordinance Amendment that would allow <br />accessory structures to be construction in front of the principal structure in the Rural <br />Zoning District. However, this proposal will not be initiated until the Zoning Ordinance <br />is updated some time next year. <br />The Planning and Zoning Board reviewed this Variance at their 10/11/00 meeting and <br />expressed concern regarding the 7/1 transition air space requirement. They <br />recommended approval of the Variance pending clarification of this question. Staff <br />reviewed the information and discussed the requirement with Air Park Board members. <br />A drawing is attached detailing this information that was not available for the P & Z <br />review. <br />The Air Park Association has tried to be more diligent in recent years in maintaining their <br />Covenants and enforcing this slope requirement. Some hangers were built in the late <br />1980's and early 90's that do not meet the requirement. These hangers are located on the <br />east end of the field on Thomas Street. We have found, however, that this 7/1 transition <br />air space requirement, while included in the Air Park Covenants, is not a required <br />condition per MnDot Office of Aeronautics rules for a "private" air park. <br />After discussion with Air Park Board members and review of the information provided <br />we would recommend approval of the Variance as requested. The structure can not be <br />located in the rear yard and meet the 7/1 slope requirement. <br />OPTIONS: <br />1. Approve Variance Request <br />2. Deny Variance Request <br />3.
