MEETING DATE: November 13, 2000 <br />TOPIC: Clearwater Creek Business Center <br />Amendments to Conditions of Approval <br />VOTE REQUIRED: 3/5 <br />BACKGROUND <br />The preliminary plat for the Clearwater Creek Business Center was approved by the City <br />December 15, 1997. The approval of the Dairy Queen site plan includes the condition <br />that the final plat must be completed. <br />Standard City policy for final plat approval requires that the conditions of approval must <br />be met. There were 11 conditions approved with the preliminary plat. Two of the <br />conditions refer to floodplain issues: <br />#7. The 100 -year floodplain elevation, building pad elevations, and street elevations <br />are identified. <br />#10. That there be a letter of map revision obtained by the applicant from FEMA <br />relating to the floodplain. <br />These conditions have not been met. However, the floodplain map has been revised for <br />areas around the Dairy Queen site. The Federal Emergency Management Agency <br />(FEMA) has requested a new Letter of Map Revision (LOMR) application including <br />additional technical information before further revising the Flood Insurance Rate Map <br />(FIRM) in this area. Because the Dairy Queen is awaiting final plat approval, staff <br />recommends amending the conditions of approval as follows: <br />Delete preliminary plat conditions 7 and 10 that were approved December 15, 1997 and <br />replace them with the following condition: <br />Within one year of final plat approval, the City of Lino Lakes will prepare and <br />submit a LOMR application to redefine the Zone A area located at the southeast <br />corner of Main Street/21st Avenue. This generally includes the area to be <br />occupied by the proposed Dairy Queen and the existing Amoco. All costs related <br />to this work will be charged against the trunk credits for the Clearwater Creek <br />Business Center. <br />
