CITY OF LINO LAKES RESOLUTION NO. 26-103 AUTHORIZING PREPARATION OF PLANS AND SPECIFICATIONS FOR THE OTTER LAKE ROAD ROUNDABOUT IMPROVEMENTS, OTTER CROSSING SOUTH WHEREAS, improvements to Otter Lake Road are required to continue development of the Otter Crossing South development, located in the southwest quadrant of Main Street and Otter Lake Road; and WHEREAS, CLINO, LLC ( the "Developer") has requested that the City's Engineer prepare the plans and specifications for improvements to Otter Lake Road including design of a roundabout; and WHEREAS, WSB, Inc., the City Engineer, has submitted a proposal to prepare the design for roadway improvements; and WHEREAS, the City finds that it would be in the best interest of the City to proceed with the preparation of plans and specifications provided the Developer is responsible for 100% of the costs of the design; and NOW, THEREFORE BE IT RESOLVED by the City Council of Lino Lakes, Minnesota Authorizes the Preparation of the Plans and Specifications for Otter Lake Road Roundabout project in the amount of $183,942 subject to the following conditions: 1. CLINO, LLC or its assigns shall enter into a Deposit Agreement with the City prior to WSB LLC proceeding with the improvements. 2. The form and content of the agreement shall in subject to the review and approval of the City Attorney. 3. The agreement shall provide for deposit of a cash escrow to cover the cost of said plans and specifications and provide for the City's right to reimbursement of costs incurred under the agreement. BE IT FURTHER RESOLVED, that staff is authorized to enter into an agreement with WSB LLC for the preparation of plans and specifications upon receipt of an executed deposit agreement from the Developer.
