• <br />• <br />Council Member <br />adoption: <br />introduced the following resolution and moved its <br />CITY OF LINO LAKES <br />RESOLUTION No. 2001 -02 <br />RESOLUTION DENYING A VARIANCE FOR CHRIS LYDEN RESIDENCE AT <br />6275 Holly Drive, Lino Lakes, MN. <br />WHEREAS, a request has been submitted to the City Council for a Variance from <br />the City of Lino Lakes Zoning Ordinance at 6275 Holly Drive, Lino Lakes, MN., and <br />WHEREAS, Section 3, Subd. 4.D.8.d.5) of the City Zoning Ordinance prohibits <br />accessory buildings with metal corrugated siding or roof, except upon tool sheds less than <br />four hundred (400) square feet in area, and <br />Whereas, the same section of the Zoning Ordinance does not allow pole buildings, <br />and <br />WHEREAS, the applicant desires to build a pole building with metal corrugate <br />siding <br />and roof, and <br />WHEREAS, the Zoning Ordinance provides that in considering all requests for <br />variance or appeal and in taking subsequent action, the City shall make a find of fact: <br />1. That the property in question cannot be put to a reasonable use if used under <br />conditions allowed by the official controls. <br />2. That the plight of the landowners is due to physical circumstances unique to his <br />property not created by the land owner. <br />3. That the hardship is not due to economic considerations alone and when a <br />reasonable use for the property exists under the terms of the ordinance. <br />4. That granting the variance requested will not confer on the applicant any <br />special privilege that would be denied by this ordinance to other lands, structures, <br />or buildings in the same district. <br />5. That the proposed actions will be in keeping with the spirit and intent of the <br />ordinance. <br />And, <br />WHEREAS, the City Council of the City of Lino Laks does not make those <br />findings in relation to this request. <br />
